Information We Collect2.1 Information You ProvideAccount Information: If you create an account using email and password or Sign in with Apple, we collect your email address, username, and authentication credentials. Sign in with Apple may also provide your name (first sign-in only).Guest Usage: If you use Phytria without an account, we generate a device-based identifier (Apple's Identifier for Vendor) to associate your data with your device. No personal information is required.Plant Data: Plant names, identification results, care reminders, journal entries, notes, and other content you create within the App.Photos: Images you capture with your camera or select from your photo library for plant identification and your collections.Community Contributions: When you share a plant pin publicly, we collect the pin's location, plant information, photos, and associated metadata.2.2 Information Collected AutomaticallyLocation Data: With your permission, we collect your device's GPS coordinates when you create a plant pin. Location accuracy is configurable (approximate to precise) in App settings.Photo Metadata (EXIF): When you take or select a photo, we may extract metadata including GPS coordinates, camera model, timestamps, altitude, and editing software information. This metadata is used for data integrity verification on community pins.Device Information: If you opt in to crash reporting, we collect device model, operating system version, available memory, and storage information for diagnostic purposes.2.3 Information We Do NOT CollectWe do not collect advertising identifiers (IDFA), browsing history or activity outside the App, contacts, calendars, or messages, health, financial, or biometric data, or behavioral tracking or profiling for advertising.3. How We Use Your InformationWe use the information we collect to:Provide Core Features: Identify plants from your photos, display pins on the community map, manage your personal plant collections, and send care reminder notifications.Manage Subscriptions: Track your subscription tier and identification usage to enforce plan limits and provide the appropriate level of service.Maintain Data Integrity: Verify the authenticity of community-submitted photos using EXIF metadata analysis.Improve the App: Diagnose technical issues and improve performance through opt-in error and crash reporting.Authenticate Users: Manage your account, secure your data, and enable data migration between guest and authenticated sessions.Provide Plant Diagnosis: On supported devices (iOS 26+), power on-device AI-assisted plant health diagnosis using Apple Intelligence. How We Share Your InformationWe do not sell, rent, or trade your personal information to third parties.We share information only in the following limited circumstances:4.1 Community Pins (User-Initiated)When you choose to share a pin publicly, the following information becomes visible to other Phytria users on the community map: pin location (latitude and longitude), plant name and identification details, photos you attached to the pin, date the plant was found, and habitat and abundance information.Your email address, account name, and device identifier are not displayed to other users on community pins.4.2 Service ProvidersWe use the following third-party services to operate the App. These providers process data on our behalf and are contractually obligated to protect your information:Plant.ID (Flora Inc.) — Purpose: Plant identification. Data shared: Photos, GPS coordinates (optional). Location: Central Europe (EU).Supabase — Purpose: Cloud database and photo storage for community pins. Data shared: Pins, photos, metadata, user identifiers. Location: United States.Wikipedia / Wikimedia — Purpose: Plant physiology information for diagnosis. Data shared: Plant scientific names (no personal data). Location: United States.4.3 Legal RequirementsWe may disclose your information if required by law, court order, or governmental request, or to protect the rights, safety, or property of Botanéau Group LLC, our users, or the public.5. Third-Party Services5.1 Plant.ID APIWhen you identify a plant, your photo (and optionally your location) is sent to the Plant.ID service operated by Flora Inc., based in the European Union. Plant.ID processes the image to return identification results. We do not control how Plant.ID retains or processes images after identification. Please refer to Plant.ID's Privacy Policy for details.5.2 Apple Intelligence (On-Device)On devices running iOS 26 or later, Phytria offers AI-powered plant health diagnosis using Apple's on-device Foundation Models. All diagnosis processing occurs locally on your device. No diagnosis conversation data is sent to Botanéau Group LLC, Apple, or any third party.5.3 RSS FeedsThe App displays plant-related news from public RSS feeds. We fetch articles from these sources but do not send any personal data to the feed providers.5.4 Apple Sign InIf you sign in with Apple, authentication is handled by Apple. We receive only the information you authorize Apple to share (typically your email and name). Please refer to Apple's Privacy Policy for details.6. Data Storage and Security6.1 Local StorageThe majority of your data is stored locally on your device:App Database: Your plants, collections, identification history, care reminders, and journal entries are stored in an on-device database protected by iOS data encryption.Keychain: Authentication tokens and credentials are stored in the iOS Keychain, Apple's secure credential storage system.Preferences: App settings are stored locally on your device.6.2 Cloud StorageCommunity pins and their associated photos are stored on our Supabase-hosted backend in the United States. Photos are stored in a private storage bucket and are accessible only through time-limited signed URLs (1-hour expiration).6.3 Security MeasuresWe implement the following security measures: all network communication uses HTTPS/TLS encryption in transit, iOS data protection encryption at rest for local storage, secure Keychain storage for credentials and tokens, certificate pinning support for API connections, and image compression before transmission to minimize data exposure.No method of electronic storage or transmission is 100% secure. While we strive to protect your information, we cannot guarantee absolute security.7. Data RetentionLocal plant data and collections: Until you delete it or uninstall the App.
Deleted items: A short recovery period, then permanently removed.
Community pins and photos: Until you delete them or request account deletion.
Error and crash reports (local): Automatically deleted after a limited period.
Cached data (RSS, network): Temporary; automatically cleared periodically.
Authentication credentials: Until you sign out or delete your account.
Subscription and transaction records: As required by Apple and applicable law.
8. Your Rights and Choices8.1 Access and ExportYou can export all of your local data at any time using the in-app data export feature. This creates a portable archive (.phytria file) containing your plants, pins, collections, photos, and journal entries.8.2 DeletionIndividual Items: Delete any pin, plant, collection, or journal entry from within the App. Deleted items are recoverable for a short period, then permanently removed.Account Deletion: You can delete your account from the App's profile settings. This removes your authentication data and local data. To request deletion of community pins stored on our servers, contact us at [email protected].8.3 PermissionsYou can revoke any device permission (camera, location, photo library, notifications) at any time through your device's Settings app. Some features may not function without certain permissions.8.4 Privacy ControlsThe App provides in-app privacy settings, including:Analytics: Opt-in only (disabled by default).
Crash Reports: Enabled by default; can be disabled in settings.
Location Accuracy: Choose between low, medium, and high accuracy.
Cellular Data: Restrict the App to Wi-Fi only.
Private Mode: Prevent your collections from being shared.
Global Sharing: Choose whether your pins are shared to the community map.
9. International Data TransfersBotanéau Group LLC is based in the United States. If you are located outside the United States, please be aware that your information may be transferred to and processed in the United States (via Supabase) and the European Union (via Plant.ID).For users in the European Economic Area (EEA), United Kingdom, or Switzerland, we rely on the following transfer mechanisms: Standard Contractual Clauses (SCCs) approved by the European Commission, data processing agreements with our service providers, and your explicit consent when you choose to share community pins.10. Children's PrivacyPhytria is not intended for children under the age of 13. We do not knowingly collect personal information from children under 13. If you are a parent or guardian and believe your child under 13 has provided us with personal information, please contact us at [email protected] and we will promptly delete such information.If we become aware that we have collected personal information from a child under 13 without verified parental consent, we will take steps to delete that information as quickly as possible.11. Please read these Terms of Service ("Terms") carefully before using the Phytria mobile application (the "App") operated by Botanéau Group LLC ("we," "us," or "our"). By downloading, accessing, or using Phytria, you agree to be bound by these Terms. If you do not agree, do not use the App.1. EligibilityYou must be at least 13 years of age to use Phytria. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.2. Account RegistrationYou may use Phytria as a guest or create an account using email and password or Sign in with Apple. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate and complete information when creating an account and to update it as necessary. You must notify us promptly if you become aware of any unauthorized use of your account.3. Acceptable UseYou agree to use Phytria only for lawful purposes and in accordance with these Terms. You agree not to:Upload, submit, or share content that is false, misleading, defamatory, obscene, hateful, threatening, or that violates any third party's rights.Use the App to harass, abuse, stalk, or harm other users.Submit fraudulent plant identifications, fake photos, or manipulated metadata with the intent to deceive the community.Attempt to interfere with, disrupt, or gain unauthorized access to the App's systems, servers, databases, or other users' accounts.Use automated scripts, bots, scrapers, or other automated means to access or interact with the App.Reverse engineer, decompile, disassemble, or otherwise attempt to extract the source code of the App.Use the App in any manner that could damage, disable, overburden, or impair our infrastructure or interfere with any other party's use of the App.Circumvent, disable, or otherwise interfere with any security, rate-limiting, or access-control features of the App.Resell, sublicense, or commercially exploit the App or any content obtained through the App without our prior written consent.4. Account Suspension and TerminationWe reserve the right, at our sole discretion, to suspend, restrict, or permanently terminate your account and access to Phytria, with or without prior notice, for any reason, including but not limited to: violation of these Terms, abusive or disruptive behavior, fraudulent activity, submission of manipulated or deceptive content, actions that threaten the integrity or security of our systems, or any conduct we reasonably determine to be harmful to Phytria, its users, or its infrastructure.Upon termination, your right to use the App will immediately cease. We may delete your account data, including community pins, photos, and associated content. Any data stored locally on your device will remain accessible to you unless you uninstall the App. We are not liable to you or any third party for any suspension or termination of your account.5. User-Generated Content5.1 Your ContentYou retain ownership of all content you submit, upload, or create through Phytria, including photos, plant data, journal entries, and community pins ("Your Content"). However, by submitting Your Content to the App, particularly when sharing community pins publicly, you grant Botanéau Group LLC a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, display, reproduce, modify (including resizing, compressing, and reformatting), distribute, and publicly display Your Content in connection with operating, promoting, and improving the App and its services.This license continues for as long as Your Content remains on the App and for a reasonable period thereafter to allow for technical removal. You may revoke this license for specific content by deleting it from the App. For community pins stored on our servers, you may request deletion by contacting us at [email protected].5.2 Content ResponsibilityYou are solely responsible for Your Content and the consequences of sharing it. You represent and warrant that you own or have the necessary rights and permissions to submit Your Content and to grant the license described above. We do not endorse, verify, or guarantee the accuracy of any user-generated content, including plant identifications, and are not responsible for any errors or reliance on such content.5.3 Content ModerationWe reserve the right, but are not obligated, to review, monitor, edit, or remove any user-generated content at our sole discretion, including content that we believe violates these Terms or is otherwise objectionable.6. Plant Identification and Diagnosis DisclaimerPhytria provides plant identification and diagnosis features for informational and educational purposes only. These features are not a substitute for professional botanical, agricultural, horticultural, or medical advice.Plant identifications are generated by third-party services and on-device AI models, and may be inaccurate or incomplete. You should never rely solely on Phytria to determine whether a plant is safe to consume, touch, or use for any medicinal purpose. We are not responsible for any harm, injury, or damage resulting from actions taken based on information provided by the App, including but not limited to misidentification of toxic, allergenic, or otherwise dangerous plants.7. Intellectual PropertyThe App and its original content (excluding user-generated content), features, functionality, design, and branding are and will remain the exclusive property of Botanéau Group LLC. The App is protected by copyright, trademark, and other intellectual property laws. You may not use our name, logo, or branding without our prior written consent.8. Subscriptions and PaymentsPhytria offers a free tier and optional paid subscription plans. All subscriptions are billed through Apple's App Store. By purchasing a subscription, you agree to Apple's terms and conditions for in-app purchases and subscriptions.Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Free trials automatically convert to paid subscriptions unless cancelled before the trial period ends. You can manage or cancel your subscription at any time through your Apple ID account settings.Refunds are handled by Apple in accordance with their refund policies. We do not process payments or issue refunds directly. For details, please refer to Apple's Terms and Conditions.9. DisclaimersThe App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, Botanéau Group LLC disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and availability.We do not warrant that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant that plant identifications, diagnoses, or other information provided through the App will be accurate or reliable.10. Limitation of LiabilityTo the fullest extent permitted by applicable law, Botanéau Group LLC, its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, personal injury, or property damage arising out of or related to your use of the App, regardless of the theory of liability.In no event shall our total aggregate liability to you for all claims arising out of or related to these Terms or your use of the App exceed the amount you have actually paid to us through the App in the twelve (12) months immediately preceding the event giving rise to the claim, or fifty US dollars ($50), whichever is greater.Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.11. Governing LawThese Terms shall be governed by and construed in accordance with the laws of the State of Hawaii, United States, without regard to its conflict of law provisions.13. Dispute Resolution13.1 Mandatory ArbitrationYou and Botanéau Group LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms or the use of the App shall be resolved through binding individual arbitration, rather than in court, except that either party may bring claims in small claims court if eligible.Arbitration shall be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. Arbitration shall take place in the State of Hawaii, or at our election, may be conducted remotely via telephone, video conference, or written submissions. The arbitrator's decision shall be final and binding.13.2 Class Action WaiverYou agree that any arbitration or legal proceeding shall be conducted only on an individual basis and not as a class action, collective action, representative action, or private attorney general action. You waive any right to participate in a class action or class-wide arbitration.13.3 ExceptionEither party may seek injunctive or other equitable relief in a court of competent jurisdiction in the State of Hawaii to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights.14. SeverabilityIf any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. Entire AgreementThese Terms, together with our Privacy Policy, constitute the entire agreement between you and Botanéau Group LLC regarding your use of Phytria and supersede all prior agreements, understandings, and communications, whether written or oral.17.
